Acknowledgement of Risk & Waiver of Liability
By agreeing to this waiver, I acknowledge and agree to the following on behalf of myself or the minor student (the “Student”) named above:
Right to Waive: I have the right and ability to waive all rights and legal claims against Freda’s Kitchen, Texas sole proprietor company (the “Company”) and its affiliates on behalf of myself and the Student.
Risks Associated with Cooking Activities: I understand that although the Company prioritizes safety for its students, participation in the cooking classes and other activities hosted by the Company (the “Activities”) involves an inherent risk of injury and illness including but not limited to cuts, falls, burns, allergic reactions and other risks associated with preparing and consuming food. I further understand that the Activities may include food preparation, which will require the use of potentially dangerous kitchen equipment such as knives, electric mixers, blenders, gas or electric stoves, microwave ovens, conventional ovens, etc., and that other children or adults will be present during the Activities and working with the same equipment. I hereby elect to voluntarily participate or allow the Student to participate in said Activities. I assume full responsibility for any risks of loss, property damage or personal injury that the Student, my property or I may sustain as a result of being engaged in such Activities, whether caused by the negligence of the Company, it affiliates, officers, agents or employees or otherwise. I hereby acknowledge that I know of no medical reason why the Student or I should not participate in the Activities, including, but not limited to food allergies or sensitivities. In the event of emergency, I give my consent to the Company to provide medical care to the Student or me, as applicable, and to give authority to any emergency personnel to render immediate aid.
GENERAL RELEASE: IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN THE ACTIVITIES PROVIDED BY THE COMPANY, I, FOR MYSELF AND ON BEHALF OF THE STUDENT, HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE THE COMPANY, ITS AFFILIATES, OFFICERS, AGENTS OR EMPLOYEES (COLLECTIVELY, THE “RELEASEES”) FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS AND CAUSES OF ACTION OF ANY KIND OR NATURE ARISING OUT OF OR RELATED TO ANY LOSS, DAMAGE OR INJURY, THAT I OR ANY OF MY PROPERTY MAY SUSTAIN RESULTING FROM MY PARTICIPATION IN OR IN ANY WAY CONNECTED WITH MY PARTICIPATION IN SUCH ACTIVITIES, REGARDLESS OF WHETHER SUCH LOSS IS CAUSED BY THE NEGLIGENCE OF THE RELEASEES AND REGARDLESS OF WHETHER SUCH LIABILITY ARISES IN TORT, CONTRACT, STRICT LIABILITY OR OTHERWISE. I further agree to indemnify and to hold the Releasees free and harmless from any loss, liability damage, cost, or expense which
they may incur as a result of an injury that the Student or I may sustain while participating in the Activities.
Photo and Video Release: I consent and give my permission to the Company to disclose the Student’s or my identity and to reproduce and distribute videos, films and photographs of the Student or me for Company promotional materials.
I further covenant and agree that this Acknowledgement of Risk and Waiver of Liability (this “Release”) shall be construed in accordance with the laws of the State of Texas, and that it shall not be construed against the drafter. Furthermore, any mediation, suit or other proceeding relating to this Release and any activities covered hereby must be filed or entered into only in Texas and the federal or state courts located in Travis County, Texas. Any portion of this Release deemed unlawful or unenforceable is severable and shall be stricken without any effect on the enforceability of the Release as a whole to the full extent authorized by law.
